Pittsburgh’s Zoning Board of Adjustment has scheduled the following public hearing of interest to South Pittsburgh residents in the first floor hearing room of the John P. Robin Civic Building, 200 Ross Street, Downtown.

Zone case 205/13 on Thursday, Oct. 31 (Continued from Thursday, Sept. 19) at 9:40 a.m. is the appeal of Carlysle Associates LP, owner and applicant, for 2715 Sarah Street in the 16th Ward (Zoning District R2-VH).

Applicant requests use of two-story structure as an office (limited); real estate office.

Special Exception: 921.02.A.4: Change from one nonconforming use to another is a Special exception.

Past Cases and Decisions: Zoning Case #287 of 2006, applicant’s request for use of two-story structure as a real estate services office with eight employees 8:00 a.m. to 6 p.m. Monday through Friday was approved.

Notes: Certificate of Occupancy dated 1988 permitted occupancy “Use of two-story structure as photography studio on the first floor with one dwelling unit above and two outdoor parking stalls in rear.”

Zone case 187/13 on Thursday, Oct. 31 at 9:50 a.m. (continued from Thursday, Sept. 19) is the appeal of Pittsburgh Rugby Association II LLC, owner and applicant for 40 S. 22nd Street in the 16th Ward (Zoning District R1A-VH).

Applicant requests existing restaurant expansion: 21’ x 16’ two-story addition at rear of existing structure.

Special Exception: 921.02.A.1; Expansion of a nonconforming use is a Special Exception.

Variances: 921.02.A.1.(a)(i): Limit of Expansion 15%; 50% requested. 903.03.E.2: Minimum 3’ interior side setback required and 0’ proposed; Minimum 5’ exterior side setback required and 0’ proposed; Minimum 15’ rear side setback required and 0’ proposed.

Notes: Certificate of Occupancy 69537, dated 6/7/1997, permitted occupancy “Existing two-story structure for bar/restaurant with one dwelling unit above and outdoor seating in rear of building and 6’6” high stockade fence. Maximum of 45 occupants inside; 30 outside.”

Zone case 196/13 on Thursday, Oct. 31 at 10:00 a.m. is the appeal of Karen Lucca, owner and applicant for 264 Plymouth Street in the 19th Ward (Zoning District R1D-M).

Applicant requests use of structure as two-family dwelling with existing two-car parking area at rear.

Variances: 911.04: Use is not permitted in R1D zoning district; 903.03.C.2: For parking area: Minimum 5’ interior side setback required and 0’ requested.

Zone case 197/13 on Thursday, Oct. 31 at 10:10 a.m. is the appeal of Mark and Mary Beth Wrigley, owners, and Michael Wright, applicant for 133 S. 20th Street in the 17th Ward (Zoning District R1A-VH).

Applicant requests use of existing 2½-story structure as two-family dwelling.

Special Exception: 921.02.A.4: Change from one nonconforming use to another is a Special Exception.

Notes: Certificate of Occupancy 64859, dated 4/27/1993, permitted occupancy “Use of first floor as a dental office with one dwellin unit above to remain.” Certificate of Occupancy dated 2/6/2001, permitted occupancy “2½ story structure with dentist office on first and second floor.”

Zone case 214/13 on Thursday, Oct. 31 at 10:20 a.m. is the appeal of James R. Smith, owner and applicant for 208 Reifert Street in the 30th Ward (Zoning District R1D-H).

Applicant requests use of existing structure as two-family dwelling.

Variances: 911.02: Use of two-family dwelling units is not permitted in R1D zoning district. 914.02.A: One additional parking space required; no parking spaces requested.

Notes: Certificate of Occupancy 15232, dated 6/19/1961, permitted occupancy “One family dwelling.”

Zone case 242/13 on Thursday, Nov. 7 at 9:00 a.m. is the appeal of Dramble Tia, owner and applicant for 300 Beltzhoover Avenue in the 18th Ward (Zoning District R1D-H).

Applicant requests a 6’ high solid fence for single-family dwelling.

Variances: 925.06.A.2: Maximum 4’ high open fence permitted; 6’ high solid fence requested.

Notes: Certificate of Occupancy 90696, dated 9/8/2004, permitted occupancy “Two-story one-family dwelling with one-story one-car detached garage.”

Zone case 179/13 on Thursday, Nov. 7 at 9:10 a.m. is the appeal of Jason and Erin Appelt, owners, and Peter Margittai, applicant, for 145 S. 15th Street in the 17th Ward (Zoning District R1A.VH).

Applicant requests a protest appeal of zoning approval for use of property as a two-family dwelling.

Protest Appeal: 923.02.B.1; 923.02.D: Appeal to the Zoning Board of Adjustment.

Past cases and decisions: ZBA 174 of 2012, applicant’s request to use three-story structure as a two-family dwelling was Denied.

Notes: Certificate of Occupancy permit 12-OCC-00533, dated 10/9/2012, occupancy is for use of existing structure as two-family dwelling one-unit on 1st and 2nd floors and one unit on 3rd floor.
