This week at the Pittsburgh Zoning Board

Pittsburgh's Zoning Board of Adjustment has scheduled the following public hearings of interest to South Pittsburgh residents in the first floor hearing room of the John P. Robin Civic Building, 200 Ross Street, Downtown.

Zone case 9/12 on Thursday, Jan. 26 at 9:10 a.m. is the appeal of Victor Rodriguez, applicant, and Board of Public Education, owner for 161 Prospect Street in the 19th Ward (Zoning District R1D-H).

Applicant requests conversion of the existing four story structure into 80 units residential building with recreation and entertainment, indoor (general)- fitness center with 104 surface parking spaces.

Variance Requests: 911.02 – Use is not permitted in residential single unit detached district; 903.03.D.2 — Exterior side yard setback for parking stalls, 15 ft. required and 3 ft. requested; interior side yard setback, 5 required and 3 ft. requested; 40 ft (3 stories) in maximum height required and 60 ft. (4 stories) requested.

Notes: Certificate of Zoning Classification, dated 9/29/2000, described the use of property as "Two story brick school building."

Zone case 16/12 on Thursday, Jan. 26 at 9:20 a.m. is the appeal of Delaware McDonalds Corp., owner/applicant, for 624 Browsville Road in the 30th Ward (Zoning District LNC).

Applicant requests a new one-story fast food restaurant (general).

Special Exception Request: 921.03.C – Restoration of Nonconforming Structure containing a Nonconforming use is a Special Exception (new curb cut in pedestrian right-of-way is not permitted in the LNC).

Variance Requests: 922.04.E.3.b – The street level facade shall be transparent for no less than 60% of horizontal length of the building facade and 22% requested; 922.04.E.3.c — A primary structure does not provide a street level doorway; 922.04.E.3.i — No parking spaces shall be located between the front building and the front lot line and 20 spaces provided; 922.04.E.3.ii — Off-street parking spaces area located on the side of building requires that facade of the building is transparent and a drive -thru side proposed; 914.09.A.1 — Off-street parking areas in LNC requires a minimum 10 ft. of the street right-of-way and 4 ft. requested.

Notes: Certificate of Occupancy dated 1985 permitted occupancy "One-story structure for use as a fast food restaurant with 29 outdoor parking stalls (two designated handicapped) and drive-thru facilities (6' solid fence southerly side and trash enclosure in rear);" Certificate of Occupancy 200801972, dated 6/23/2009, permitted occupancy "One double-sided ground pole internally-illuminated 3'x8' business ID sign (changeable letters) at front of existing one-story fast food restaurant (McDonalds)."

Zone case 11/12 on Thursday, Jan. 26 at 9:30 a.m. is the appeal of John Bazari, owner/applicant, for 300 Kramer Way in the 19th Ward (Zoning District R1D-H).

Applicant requests use of two-story structure as two-family dwelling.

Variance Request: 911.02 – Use is not permitted in Residential single unit district.

Notes: Certificate of Zoning Classification 142394, dated 11/4/2011, current use of property: 1 family dwelling.

Zone case 13/12 on Thursday, Jan. 26 at 9:40 a.m. is the appeal of Richard Riedel, applicant, and Messa Joseph L. Sr. and Ciaffoni Messa Virginia, owners for 2230 East Carson Street in the 16th Ward (Zoning District LNC).

Applicant requests use of commercial parking (limited).

Special Exception Request: 911.04.A.44 – Use is a Special Exception in LNC district.

Past Cases & Decisions: ZBA 250 of 1974, variance requested to permit erection of two advertising ground signs, 12'x6', variance granted; ZBA 697 of 1983, Special Exception requested to permit occupancy as a 22 car parking area to serve a commercial use at 2228 East Carson Street, SE and variance granted for one year only; ZBA 291 of 1985, requested to permit occupancy of the subject property as an 18-stall parking area to serve an abutting commercial use located at 2228 East Carson Street, Special Exception granted subject to paving and site-plan approval by Zoning Administrator.

Notes: Certificate of Zoning Classification 10719, dated 3/4/1987, present use of subject property described as parking lot; Certificate of occupancy 50948, dated 3/12/1987, permitted occupancy "Parking lot to serve abutting commercial use at 2228 East Carson Street."

Zone case 222/11 (continued) on Thursday, Jan. 26 at 10:10 a.m. is the appeal of LBRA ARCHITECTURE/Stephen Sobina, applicant, and 3010 Jane Street LLC, owner for 3002 Jane Street in the 16th Ward (Zoning District UI).

Applicant requests renovation of an existing four-story structure for new 18 dwelling units.

Special Exception Request: 911.04.A.85 – Use of 18 dwelling units in Urban Industrial district is a Special Exception.

Variance Request: 18 parking spaces required, 10 provided.

Notes: Certificate of Zoning Classification 139550, dated 4.25, 2011, described current and proposed use of property as "light manufacturing."
